Deed Basics: What are the types of Deeds

For a property transfer to be valid in the state of Georgia, the transfer must be documented by a document called a deed. A deed is pretty much a contract or receipt showing who owns a piece of property. It documents who currently owns the property and who gave the property to the current owner.


Various types of deeds are used for real estate transfers in Georgia. The type to use depends on the specific circumstancesand the amount of protection the parties want or need. The most common deed types used in Georgia are a warranty deed, limited warranty deed and quitclaim deed; with the warranty deed being most protective of the new owner of the property.


Here’s a bit more information about each deed:


  • Warranty Deed: The warranty deed is regarded as the premium deed type, The seller (otherwise known as the grantor) asserts that the property is free from any and all undisclosed issues and assumes responsibility for any future complications.

  • Limited Warranty Deed: This deed provides some protection to the new owner of the property but only guarantees that the property is free from issues during the time the seller owned the property. Under this deed type, the seller is not liable for pre-existing issues predating the time they owned the property.

  • Quitclaim Deed: This type of deed provides no guarantees regarding the title's clarity. For this reason, this type of deed is commonly utilized among family members or to rectify title complications.

There are also other deed types used for specific situations, such as:

  • Deed of Gift: Used to transfer property as a gift.

  • Executor's Deed: Used by an executor of an estate to transfer property according to the will.


While there exist other deed types for specific circumstances, the aforementioned are the primary ones.
